Welcome to ProspectOut. By engaging in our cold email marketing and appointment-setting services, you agree to the following terms and conditions. Please read them carefully before using our services.

Guarantee of Results
As a B2B lead generation agency, ProspectOut does not guarantee specific outcomes from its services. Results may vary depending on several factors, including market competition, demand for your products or services, online presence, and other client-specific variables.

Refund Policy
Since ProspectOut covers all costs associated with secondary domains, email accounts, and required tools through monthly subscriptions, all service fees paid to ProspectOut are non-refundable.

Billing Cycle
The client’s billing cycle begins on the date the subscription is activated and ends on the corresponding date of the following month. After each billing cycle, the subscription will automatically renew and the client’s payment method will be charged under the same terms, unless the client cancels the subscription or ProspectOut terminates it.

Cancellation Policy
Clients have the flexibility to cancel our services at any time, effective at the end of their billing cycle. This provides clients with the freedom to adjust their marketing strategy as needed. Please be aware that cancellation does not entitle clients to a refund of any prepaid service fees. The cancellation will take effect from the next billing cycle, and no future charges will be incurred.

Pricing Models
ProspectOut offers three engagement models. Please review the model that applies to your subscription below.
Monthly Retainer Model
Under the monthly retainer model, the client is charged a fixed fee on a monthly basis. This fee is all-inclusive, with no additional costs unless otherwise agreed in writing.
Pay-Per-Meeting Model
Under the pay-per-meeting model, the client is responsible for covering the costs of email accounts and any required third-party tools. In addition, the client will be charged a fee for each qualified meeting delivered.
Commission-Based Model
Under the commission-based model, the client is responsible for covering the costs of email accounts and any required third-party tools. Additionally, ProspectOut will charge a commission based on the client’s gross revenue generated from each sale or client acquired through our services.

Ownership of Marketing Materials
The client retains full ownership of all marketing materials created during the course of our services. However, any domains, email accounts, and automation tools provided as part of our service are maintained on a monthly subscription basis. Upon cancellation or termination of services, these subscription-based assets will be discontinued and may be deleted.

Access to Campaign Information
Clients will be granted access to our sending tool dashboard, providing them with comprehensive information about the ongoing campaign. This includes visibility into campaign performance, outreach activity, and key metrics throughout the engagement.

Modification of Strategies
ProspectOut reserves the right to adjust marketing strategies based on campaign performance and changing market conditions. Such modifications will be communicated to the client, and their input will be considered in the decision-making process.

Privacy & Confidentiality
ProspectOut is committed to maintaining the privacy and confidentiality of client information. We will not disclose sensitive business information to third parties. All client data shared with ProspectOut is handled with strict confidentiality and used solely for the purpose of delivering our services.

Force Majeure
ProspectOut shall not be liable for any failure or delay in the performance of services due to circumstances beyond its reasonable control, including but not limited to acts of nature, government actions, or unforeseen technical issues. In such events, ProspectOut will notify the client as soon as reasonably practicable.

Termination of Services
ProspectOut reserves the right to terminate services if the client breaches any of the agreed-upon terms and conditions. In such cases, the client will be notified, and any outstanding fees will be due immediately upon termination.

Client Cooperation
Clients are expected to actively cooperate and provide timely feedback throughout the campaign. Lack of cooperation may impact the effectiveness of the services, and ProspectOut shall not be held responsible for suboptimal outcomes resulting from insufficient client collaboration.

Acknowledgement & Agreement

By availing of ProspectOut’s services, you acknowledge and agree to these terms and conditions. ProspectOut reserves the right to modify these terms at any time, and clients will be notified of any changes promptly.
